These Terms of Service ("Terms") govern your use of the website at hellosteady.com, the Steady Social App on web and mobile, Sherpa by Hello Steady, and any related content, features, and communications offered by Hello Steady, Inc. ("Hello Steady," "we," or "us") (together, the "Services"). By creating an account, purchasing a program, or otherwise using the Services, you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, do not use the Services.
You must be at least 18 years old and able to enter a binding contract to use the Services. The Services are intended for use in the United States.
The Services provide nonclinical education, reflection tools, and peer support. They are not therapy, counseling, medical care, or crisis services, and they are not a substitute for care from a licensed professional. Family Support Specialists provide nonclinical support and do not act in a clinical or professional healthcare capacity when working with you, even if they hold a professional license. No clinician and patient, therapist and client, or other professional relationship is created by your use of the Services. Hello Steady does not supervise or direct the treatment you or anyone else receives from any provider. Our full Disclaimer is part of these Terms.
The Services, including any SOS or urgent support feature, are not monitored in real time and are not an emergency service. If you or someone else is in danger, call 911. For crisis support, call or text 988.
Some features use artificial intelligence to generate responses. AI output may be inaccurate, incomplete, or inappropriate for your situation. You are responsible for how you use it, and you should not rely on it as professional advice or for safety decisions. We may limit, review, or change AI features at any time.
You agree to provide accurate information and keep it current. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at hello@hellosteady.com if you believe your account has been accessed without permission.
The Services may ask about other people in your life. Share only what you need to get support, and avoid sharing information you do not have a right to share. Hello Steady will not contact people you mention or a referring provider about you without your permission, except as described in our Privacy Policy or required by law.
Some Services, including Sherpa, require payment. Prices, program length, and billing terms are shown at the time of purchase. By purchasing, you authorize us and our payment processor to charge your payment method on the schedule described, including recurring charges until you cancel. You may cancel at any time through your account or by contacting us. Refunds, including any prorated refund on cancellation, are provided as described at the time of purchase. We may change prices with advance notice, and changes will not apply to a billing period you have already paid for. Beta or early access programs, as applicable, may change as we learn, and features may be added, changed, or removed.
By creating an account, you agree to receive emails and in app messages about your account and the Services. If you provide your phone number, your Specialist or our team may call or text you about your program, such as to schedule calls or follow up on your support. Message and data rates may apply. You can ask us to stop contacting you by phone or text at any time by emailing hello@hellosteady.com.
You agree not to use the Services for any unlawful purpose; harass, threaten, or harm anyone, including Specialists; share content that is abusive or violates others' privacy; attempt to access accounts, data, or systems you are not authorized to use; copy, scrape, reverse engineer, or resell the Services; or use the Services to develop a competing product.
You keep ownership of the content you submit, such as reflections, responses, and messages ("Your Content"). You grant Hello Steady a limited license to use, store, and process Your Content to provide, maintain, and improve the Services, including reviewing conversations for quality and safety, and to create de-identified or aggregated information for research and reporting, as described in our Privacy Policy.
All content, branding, features, and functionality of the Services belong to Hello Steady or its licensors. You may use them only for your personal, noncommercial use of the Services. Feedback you share may be used by us without obligation to you.
The Services may rely on or link to third party services, such as payment processing, scheduling, and outside resources. We are not responsible for third party services, and your use of them is governed by their terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. HELLO STEADY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE, OR THAT THEY WILL PRODUCE ANY PARTICULAR OUTCOME FOR YOU OR YOUR FAMILY, INCLUDING ANY RECOVERY OUTCOME.
You understand that substance use and recovery involve serious risks, and that the Services do not control the choices of you or anyone else. You use the Services voluntarily and accept responsibility for your decisions.
TO THE FULLEST EXTENT PERMITTED BY LAW, HELLO STEADY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SPECIALISTS, AND ADVISORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM THE ACTIONS OF YOU, OTHERS IN YOUR LIFE, OR ANY THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $50 IF YOU PAID NOTHING. THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY THE LAW OF YOUR STATE.
You agree to defend, indemnify, and hold harmless Hello Steady and its officers, directors, employees, contractors, Specialists, and advisors from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Services, Your Content, including information you share about others, or your violation of these Terms, applicable law, or the rights of others, to the extent permitted by law.
Before filing a claim, you agree to contact us at hello@hellosteady.com and try to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. YOU AND HELLO STEADY WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules.
You may stop using the Services and close your account at any time. We may suspend, deactivate, or delete your account, end your access to any or all of the Services, or modify or discontinue any of the Services, at any time, for any reason or no reason, with or without notice. If we end access to a paid program for reasons other than your violation of these Terms, we will refund any prepaid fees for the unused portion. Sections that by their nature should survive termination will survive.
We may update these Terms. If changes are material, we will notify you by email or in the Services before they take effect. Continued use after the effective date means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and the Disclaimer are the entire agreement between you and Hello Steady about the Services.
